Welcome to Beex, a no-code development platform provided by HDM-SOFT SAS. These Terms of Use ("Terms") govern your access to and use of the Beex platform, including all associated services, software, tools, APIs, and content made available through the domain https://beex.studio or other designated HDM-SOFT domains (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not access or use the Service.

1. Eligibility

To use the Service, you must be at least 16 years old and have the legal capacity to enter into binding contracts. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Account Registration

To access certain features of Beex, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. License and Acceptable Use

HDM-SOFT grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.

You agree not to:

  • Use the Service for any unlawful or fraudulent activity;
  • Copy, modify, distribute, sell, or lease any part of the Service without our written consent;
  • Attempt to gain unauthorized access to any portion of the Service or other users’ data;
  • Use bots, scripts, or automated tools to access or scrape the Service;
  • Transmit any viruses, malware, or other harmful code.

4. User Content and Intellectual Property

You retain ownership of all content, data, and configurations you create or upload using the Beex platform ("User Content"). However, by using the Service, you grant HDM-SOFT a worldwide, royalty-free, and non-exclusive license to host, use, process, and display your User Content solely for the purpose of providing the Service.

HDM-SOFT retains all rights, title, and interest in and to the Beex platform, its underlying technology, and all intellectual property associated with it.

5. Third-Party Services

Beex may integrate with third-party tools or services. HDM-SOFT is not responsible for the availability or functionality of such third-party services. Your use of those services is subject to their respective terms and policies.

6. Subscriptions and Billing

Certain features of Beex may be available only through paid subscriptions. All fees are non-refundable except as required by law or explicitly stated in a Service Level Agreement. You are responsible for all applicable taxes and fees related to your use of the Service.

HDM-SOFT reserves the right to modify pricing at any time with prior notice.

7. Service Availability and Support

We strive to provide reliable access to Beex but do not guarantee uninterrupted availability. Scheduled maintenance and system updates may occur. Support is available to paying users through our designated channels, and response times are defined in the applicable subscription plan.

8. Data Protection and Privacy

Your privacy is important to us. Our use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. You agree that HDM-SOFT may process your personal data in accordance with that policy.

9. Termination

You may terminate your account at any time by following the steps within the Service or contacting our support team. HDM-SOFT reserves the right to suspend or terminate your access to the Service at its sole discretion if you violate these Terms or pose a security or legal risk to the platform.

Upon termination:

  • Your license to use the Service will cease;
  • We may retain your data for backup, legal, or compliance purposes, in accordance with our data retention policies.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available." HDM-SOFT disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be error-free or secure.

11. Limitation of Liability

To the maximum extent permitted by applicable law, HDM-SOFT shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, data loss, or business interruption, arising out of or in connection with your use of the Service.

12. Indemnification

You agree to indemnify and hold HDM-SOFT harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Continued use of the Service after changes become effective constitutes your acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of France, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Clermont-Ferrand, France.
